These Terms of Service (“Terms”) which include and incorporate the Privacy Policy at https://xisumavoid.com/privacy (“Privacy Policy”), are a legal agreement between the Xisumaverse (the “Company” or “we”) and you (“you”). By using or accessing the servers on the Xisumaverse (the “Services”), you agree:
That you are 13 years of age or older.
If you are the age of majority in your jurisdiction/county of residence, that you have read, understood, and accept to be bound by the terms.
(If you are over the age of 18) That you are not a person barred from receiving services under the laws within your country of residence.
If you are between 13 years of age and the age of majority in your jurisdiction, that your legal parent/guardian has reviewed and agrees to these Terms.
We reserve the right to modify or revise these Terms at any time and you agree to be bound by such modifications or revisions. Any changes or modifications will be effective thirty (30) days following posting on the Services, and your use of the Services after the effective date will constitute your acceptance of, and agreement to such changes or modifications. If you object to any change or modification, your sole recourse shall be to stop using the Services.
Our Privacy Policy (https://xisumavoid.com/privacy) describes how we handle the information you provide to us when you use our Services. You understand that through the use of our Services you consent to the collection and use (as predefined in the Privacy Policy) of this information.
You are responsible for your log-in credentials and for any activity resulting from the use of your credentials or other activity on your account (“Account”) on the Services.
You are responsible for maintaining the confidentiality of your log-in credentials and are fully responsible for all activities that occur through the use of your credentials or otherwise on your account. You agree to notify us immediately at [email protected] if you believe the confidentiality of your log-in credentials has been compromised or if you suspect unauthorized use of your Account.
Anything you share within our Service, be it data, text or any other material shared by using the Service is “Your Content”. You represent and warrant that you own the rights to Your Content, its originality, along with the right to grant all the licenses and rights in these Terms for the Company not to acquire any obligations from third parties nor liabilities stemming from exercising said rights and licenses.
By using, uploading, transmitting or otherwise distributing Your Content within the service you grant the Company a perpetual, exclusive, non-transferable, royalty-free, sublicensable and worldwide license to use, host, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display Your Content as well as operating and providing the service.
We do not guarantee any accuracy, quality or integrity of any content posted by a user. By agreeing to these terms and using the Service you accept that you may face material that may be offensive to you or somehow objectionable. You acknowledge that the Company will not be accountable for any content submitted by users, or any damage or loss incurred by the use of said content, under any circumstances.
The Company reserves the right to remove or delete, be it temporarily or permanently, Your Content from the Service, having a reason or no reason at all, having notified you or not. You are welcome to notify the Company of any content that might violate these Terms, or any inappropriate behavior from a user.
As a condition of your use of the Service, and without limiting your other obligations under these Terms, you agree to comply with the restrictions and rules of use set forth in these Terms as well as any additional restrictions or rules (such as application-specific rules) set forth in the Service.
As an example, you agree not to use the Service in order to:
post, upload, transmit or otherwise disseminate information that is obscene, indecent, vulgar, pornographic, sexual or otherwise objectionable;
defame, libel, ridicule, mock, stalk, threaten, harass, intimidate or abuse anyone;
upload or transmit (or attempt to upload or transmit) files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files or data, or any other similar software or programs that may damage the operation of the Service or other users' computers;
violate the contractual, personal, intellectual property or other rights of any party including using, uploading, transmitting, distributing, or otherwise making available any information made available through the Service in any manner that infringes any copyright, trademark, patent, trade secret, or other right of any party (including rights of privacy or publicity);
attempt to obtain passwords or other private information from other members;
develop, distribute, or publicly inform other members of "auto" software programs, "macro" software programs or other "cheat utility" software program or applications in violation of the applicable license agreements;
exploit, distribute or publicly inform other members of any game error, miscue or bug which gives an unintended advantage; or violate any applicable laws or regulations, or promote or encourage any illegal activity including, but not limited to, hacking, cracking or distribution of counterfeit software, or cheats or hacks for the Service.
These rules of use are not meant to be exhaustive, and we reserve the right to determine what conduct we consider to be a violation of the Terms or improper use of the Service and to take action including termination of your Account and exclusion from further participation in the Service.
To facilitate the provision our Service, we use third-party services, or link to them from the Service, which does not mean we are liable, endorse or are responsible for their actions or the content shared within the services or websites you access by leaving our Service, possibly through the aforementioned links.
Any advertisement of third-party services will not be endorsed, and furthermore we are not responsible or liable for the consequences of accessing these services.
One such third-party service we use is Discord Inc. (https://discordapp.com/).We use Discord’s Services for Voice and Text communication through the Company’s Guild. Any and all content within said Guild is governed by Discord’s Terms of Service (https://discordapp.com/terms), as well as our own rules and code of conduct. Breaking either of these will result in a discontinuation of the provision of our Services, the duration of which will be dictated by us, and if necessary, will be reported to Discord for them to dictate a sanction according to their services.
You agree that we are not liable nor responsible for the content provided by any of these third-party services, nor any damage or loss caused as a result of your interaction with these services or websites.
You may terminate your Account at any time and for any reason by sending an email to [email protected].
The Company may terminate your Account and your access to the Service (or, at the Company's sole option, applicable portions of the Service) at any time and for any reason. You may, as the result of termination, lose your Account and all information and data associated therewith, as applicable and the Company is under no obligation to compensate you for any such loss.
These terms may be revised if the need arises. On these revisions, changes will not be retroactive, thus the most current version of the Terms, which will be available at all times at https://gateway.xisumavoid.com/tos, will dictate our relationship with the User. Changes that address new functions or have a legal reason to be will be in effect as soon as they’re implemented. Otherwise, a 30 day notification will be given before they become effective, be it via a Service notification, email, or official mediums. By continuing to use our Services after the changes are made effective, you agree to be bound by the new Terms.
Should any provisions of these Terms be held to be invalid or unenforceable, then such provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. If the Company were to fail in enforcing any right or license in these Terms, or provision of such, it will not be deemed as a remission of such right, license or provision.
